1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and AI ChatHistory Pro ("we", "us", or "our") regarding your use of the AI ChatHistory Pro Chrome extension (the "Extension").

By installing, accessing, or using the Extension, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the Extension.

2. Description of Service

AI ChatHistory Pro is a Chrome extension that:

• Automatically captures and saves conversations from AI platforms (ChatGPT, Claude, Gemini, Grok, and others)
• Stores conversation history locally on your device
• Provides export functionality (PDF, Markdown, JSON, Text)
• Offers optional cloud backup and sync (Pro feature)
• Enables cross-platform context injection (Pro feature)

Platform Support: The Extension works with the following AI platforms:

• ChatGPT (chat.openai.com, chatgpt.com)
• Claude (claude.ai)
• Gemini (gemini.google.com)
• Grok (grok.com, x.com)
• DeepSeek (chat.deepseek.com)
• Perplexity (www.perplexity.ai)
• Microsoft Copilot (copilot.microsoft.com)
• HuggingFace Chat (huggingface.co/chat)
• Google AI Studio (aistudio.google.com)
• NotebookLM (notebooklm.google.com)
• LMSys Arena (chat.lmsys.org, arena.lmsys.org)
• Mistral AI (chat.mistral.ai)

3. Eligibility

To use AI ChatHistory Pro, you must:

• Be at least 13 years old (or the minimum age required in your country)
• Have a valid Google Chrome browser installed
• Have the legal capacity to enter into this agreement

If you are under 18, you may only use the Extension with the consent of a parent or legal guardian.

4. Account Registration

4.1 Free Tier

You can use the Free tier of AI ChatHistory Pro without creating an account. All data is stored locally on your device.

4.2 Pro Tier

To access Pro features, you must:

• Create an account with a valid email address
• Purchase a Pro subscription through our authorized reseller (FastSpring)
• Provide accurate and complete registration information

4.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

5. Subscription and Payments

5.1 Subscription Plans

Pro subscriptions are available in the following tiers:

• Pro Monthly: $4.99/month (recurring)
• Pro Yearly: $39.99/year (recurring, 33% savings)
• Pro Lifetime: $99.95 (one-time payment)

Prices are in USD and may vary by region. All prices are subject to change with 30 days' notice.

5.2 Billing and Merchant of Record

Our order process is conducted by our online reseller FastSpring. FastSpring is the Merchant of Record for all our orders. They provide all customer service inquiries and handle returns:

• Recurring subscriptions are billed automatically on the anniversary date
• You authorize FastSpring to charge your payment method
• You can cancel recurring subscriptions at any time through the customer portal

5.3 Refund Policy

We offer refunds under the following conditions:

• Within 14 days: Full refund for any reason
• After 14 days: Refunds considered on a case-by-case basis
• Technical issues: Full refund if we cannot resolve critical bugs

5.4 Subscription Changes

You can:

• Upgrade your plan at any time (prorated charges apply)
• Downgrade at the end of your billing cycle
• Cancel auto-renewal at any time through your account settings

6. License Grant

Subject to your compliance with these Terms, we grant you a:

• Limited, non-exclusive, non-transferable, non-sublicensable
• Revocable license to use the Extension
• For personal, non-commercial purposes only

All rights, title, and interest in and to the Extension remain with us.

7. Acceptable Use

7.1 Permitted Uses

You may use AI ChatHistory Pro to:

• Capture and save your own AI conversations
• Export conversations for personal use
• Sync data across your own devices (Pro feature)

7.2 Prohibited Uses

You may NOT:

• Use the Extension to capture other people's conversations without consent
• Reverse engineer, decompile, or disassemble the Extension
• Modify, adapt, or create derivative works of the Extension
• Remove any proprietary notices or labels from the Extension
• Use the Extension for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Extension or our servers
• Use the Extension to violate any third-party terms of service
• Sublicense, sell, rent, or lease the Extension
• Use the Extension for commercial purposes without explicit permission

8. Third-Party Services

8.1 AI Platforms

AI ChatHistory Pro interacts with third-party AI platforms. Your use of these platforms is governed by their own terms and policies:

• ChatGPT: OpenAI Terms of Service
• Claude: Anthropic Terms of Service
• Gemini: Google Terms of Service
• Grok: xAI Terms of Service

We are not responsible for the content, accuracy, or practices of these third-party platforms.

8.2 Cloud Storage

Cloud Backup uses Google Drive App Data folder:

• Data is stored in your private Google Drive folder
• Google's Terms of Service and Privacy Policy apply
• You can revoke access at any time from your Google Account settings

8.3 Payment Processing

Payments are processed by FastSpring, our authorized reseller and Merchant of Record:

9. Intellectual Property

All content, features, and functionality of AI ChatHistory Pro are owned by us and protected by international copyright, trademark, and other intellectual property laws:

• Extension code and architecture
• User interface design and graphics
• Logos and branding
• Documentation and help materials

Nothing in these Terms grants you rights to use our trademarks, logos, or branding.

10. User Content

10.1 Ownership

You retain all rights to your conversation data captured by the Extension. We do not claim ownership of your conversations.

10.2 License to Us

By using the Extension, you grant us a limited license to:

• Store and process your data to provide the service
• Backup your data to cloud storage (when enabled)
• Use anonymized, aggregated data for service improvement

11. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
• IMPLIED WARRANTIES OF NON-INFRINGEMENT
• WARRANTY THAT THE EXTENSION WILL BE UNINTERRUPTED OR ERROR-FREE
• WARRANTY THAT DEFECTS WILL BE CORRECTED

We do not warrant that:

• The Extension will meet your requirements
• The Extension will be available at any particular time
• The Extension will capture all conversations perfectly
• Any errors in the Extension will be corrected

12. Limitation of Liability

This includes, but is not limited to:

• Loss of profits, data, or business opportunities
• Personal injury or property damage
• Loss of conversation data
• Unauthorized access to your data
• Any other damages resulting from your use of the Extension

Total Liability: Our total liability to you for any claims shall not exceed the amount you paid for the Extension (if any) in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless AI ChatHistory Pro and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of:

• Your use of the Extension
• Your violation of these Terms
• Your violation of any third-party rights
• Your use of captured conversations

14. Termination

14.1 By You

You can terminate this agreement at any time by:

• Uninstalling the Extension
• Deleting your account (Pro users)

14.2 By Us

We may terminate or suspend your access to the Extension at any time, with or without cause, with or without notice:

• For violation of these Terms
• For conduct harmful to other users or the service
• For security reasons

14.3 Effect of Termination

Upon termination:

• Your license to use the Extension ends immediately
• Local data remains on your device (you can delete it manually)
• Cloud backup data is deleted after 30 days
• Pro subscription refunds follow our refund policy

15. Modifications to Service

We reserve the right to:

• Modify or discontinue the Extension at any time
• Add or remove features (with notice for Pro users)
• Change pricing for Pro subscriptions (with 30 days' notice)
• Impose limits on usage (with notice)

16. Changes to Terms

We may modify these Terms at any time:

• Changes are effective immediately upon posting
• Continued use after changes constitutes acceptance
• Material changes will be notified via email or in-extension notice
• If you disagree with changes, you must stop using the Extension

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where AI ChatHistory Pro operates, without regard to conflict of law principles.

18. Dispute Resolution

18.1 Informal Resolution

Before filing a claim, you agree to contact us at support@aichathistory.pro to attempt to resolve the dispute informally.

18.2 Binding Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

18.3 Class Action Waiver

You waive any right to participate in a class action lawsuit or class-wide arbitration.

18.4 Small Claims Court

Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies.

19. Export Control

You agree to comply with all applicable export laws and regulations:

• U.S. Export Administration Regulations
• Export control laws of your country
• Economic sanctions and trade embargoes

20. Miscellaneous

20.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI ChatHistory Pro.

20.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

20.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

20.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.

20.5 Survival

Provisions that by their nature should survive termination shall survive, including:

• Disclaimer of Warranties
• Limitation of Liability
• Indemnification
• Governing Law
